These Terms of Service ("Terms") govern your access to and use of the EdgeBet mobile application, website, and related services (collectively, the "Service") operated by EdgeBet LLC, a Colorado limited liability company ("EdgeBet," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

PLEASE READ SECTION 15 CAREFULLY. IT REQUIRES THAT DISPUTES BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS AS DESCRIBED IN SECTION 15.6.

1. Acceptance of Terms

By creating an account, downloading the application, subscribing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, available at https://edgebet.io/pages/privacy-policy (the "Privacy Policy"), which is incorporated into these Terms by reference.

The Service is offered solely to individual consumers for personal use. You may not accept these Terms on behalf of any company, organization, or other entity, and any purported acceptance on behalf of an entity is void.

2. Eligibility

You may only use the Service if:

You are a resident of the United States
You are at least 18 years old (or the legal age of majority in your jurisdiction, if higher)
You are legally permitted to view sports betting–related information in your jurisdiction
You agree to comply with all applicable laws, rules, and regulations

The Service is offered and directed solely to the United States market and to residents of the United States, and is not intended for use in any other jurisdiction.

EdgeBet does not verify the legality of sports betting in your jurisdiction. It is solely your responsibility to ensure compliance with local laws.

3. Description of Service (Analytics Only)

EdgeBet provides sports betting analytics, data aggregation, and informational tools, including but not limited to odds comparisons, positive expected value ("+EV") indicators, arbitrage indicators, bonus bet and promotional offer conversion calculators, and tools that allow you to record and review wagers you have placed elsewhere ("Bet Tracking").

IMPORTANT:

EdgeBet does not place bets
EdgeBet does not accept wagers
EdgeBet does not act as a sportsbook or bookmaker
EdgeBet does not process, hold, or transmit any wager or gambling transaction
EdgeBet does not handle user funds
EdgeBet does not receive compensation based on the placement, amount, or outcome of any wager

The Service is provided for informational and educational purposes only.

Third-Party Sportsbooks and Links. The Service may include links that open a third-party sportsbook's app or website, including links that pre-populate a bet slip with a selection displayed in the Service. These links are provided solely for your convenience. Any wager is placed by you, on the sportsbook's platform, subject to the sportsbook's own terms, and is exclusively a transaction between you and that sportsbook. EdgeBet is not a party to, and has no involvement in, any wager; does not confirm whether any wager is placed, accepted, or settled; and is not responsible for the availability, odds, limits, or conduct of any sportsbook. Pre-population of a bet slip does not constitute a recommendation to place that wager.

4. No Guaranteed Profits / No Betting Advice

EdgeBet does not guarantee profitability, winning outcomes, or financial success.

You acknowledge and agree that:

All betting involves risk
Past performance does not guarantee future results
Market movement, odds changes, and execution timing may invalidate opportunities
Any use of information provided by EdgeBet is at your sole discretion and risk

EdgeBet provides mathematical and statistical analytics only. Nothing on the Service constitutes personalized financial, investment, or gambling advice, a recommendation that you place any particular wager, or a prediction or guarantee of any outcome. You alone decide whether, when, and how to act on any information provided by the Service.

5. Data Accuracy & Availability Disclaimer

While we strive to provide accurate and timely data, you acknowledge that:

Data may be delayed, inaccurate, incomplete, or unavailable
Odds and lines may change rapidly
Third-party data sources may contain errors
Technical issues may impact availability

EdgeBet makes no representations or warranties regarding the accuracy, completeness, or timeliness of any data.

User-Entered Data and Bet Tracking. Bet Tracking and any calculations derived from it depend entirely on information you enter. EdgeBet does not connect to, verify against, or reconcile with any sportsbook account, and does not confirm that any wager you record was actually placed, settled, or paid. Records, profit and loss figures, return-on-investment calculations, and summaries displayed through Bet Tracking are informational estimates only. They are not an official record of your wagering activity, are not maintained as accounting or tax records, and should not be relied upon for tax reporting, dispute resolution with any sportsbook, or any other official purpose. Your sportsbook's own records govern.

6. Assumption of Risk

You expressly acknowledge and agree that:

You assume all risks associated with sports betting
Any financial losses are entirely your responsibility
EdgeBet is not responsible for any losses, damages, or missed opportunities

By using the Service, you voluntarily assume all risks arising from your use of the information provided.

Responsible Gaming. Sports betting should be entertainment, not a source of income, and no analytical method eliminates its risks. If you believe you may have a gambling problem, or if your betting feels difficult to control, help is available: call or text 1-800-MY-RESET, or visit the National Council on Problem Gambling at https://www.ncpgambling.org. Many sportsbooks also offer deposit limits, timeouts, and self-exclusion tools, and we encourage you to use them.

7. Subscriptions & Billing

Certain features of the Service require a paid subscription.

Subscription Terms:

Subscriptions are billed in advance on a recurring basis
Pricing and billing periods are disclosed at purchase
Subscription management and cancellation are handled through the App Store (Apple)
Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the subscription tier then in effect
You may manage your subscription and turn off auto-renewal in your App Store account settings after purchase

All payments are non-refundable except as required by Apple's policies or applicable law, or as expressly provided in Section 9.

EdgeBet does not control App Store billing decisions or refund approvals.

8. Account Registration, Security & Acceptable Use

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity occurring under your account
Ensuring your account information is accurate, including keeping your account email address current

In addition, you agree not to:

Access the Service using any bot, scraper, crawler, or other automated means, or systematically copy, extract, or harvest any data, odds, calculations, or content from the Service
Republish, resell, redistribute, or make available to any third party any data, odds, indicators, or other content obtained through the Service
Use the Service, or any data obtained through it, to develop, operate, or assist any product or service that competes with EdgeBet
Share your account credentials or allow any other person to access the Service through your account
Reverse engineer, decompile, or disassemble any portion of the Service, except to the extent such restriction is prohibited by applicable law
Interfere with or disrupt the Service, circumvent any access controls or subscription tiers, or impose an unreasonable load on our infrastructure

We reserve the right to suspend or terminate accounts suspected of abuse, fraud, misuse, or violation of this Section.

9. Account Termination

EdgeBet may suspend or terminate your account at any time, with or without notice, for any reason including but not limited to:

Violation of these Terms
Abuse of the Service
Legal or regulatory requirements

You may delete your account at any time through Profile → Delete Account. Deleting your account does not automatically cancel your subscription, which must be canceled separately through your App Store account settings.

Termination Without Cause. If EdgeBet terminates or suspends your account for reasons other than your violation of these Terms, suspected fraud or abuse, or a legal or regulatory requirement, and you hold a prepaid subscription at the time of termination, EdgeBet will provide a prorated refund or equivalent credit for the unused portion of your then-current subscription period. Because subscription payments are processed by Apple, EdgeBet will request that Apple issue such a refund; where Apple declines or is unable to do so, EdgeBet will make a good-faith effort to provide an equivalent remedy directly. Nothing in Section 7 limits your rights under this Section.

10. Limitation of Liability

To the maximum extent permitted by law:

EdgeBet LLC, its owners, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to:

Financial losses
Lost profits
Lost bets
Data inaccuracies
Service interruptions

EdgeBet's total liability, if any, shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

This limitation applies even if EdgeBet has been advised of the possibility of such damages and regardless of the legal theory under which a claim is brought.

11. Indemnification

You agree to indemnify and hold harmless EdgeBet from any claims, damages, losses, liabilities, or expenses arising from:

Your use of the Service
Your betting activity
Your violation of these Terms
Your violation of any law or regulation

12. Intellectual Property

All content, software, algorithms, branding, and materials provided by EdgeBet are owned by or licensed to EdgeBet and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only.

13. Modifications to the Service or Terms

We reserve the right to modify or discontinue the Service, in whole or in part, at any time.

Non-Material Changes. We may update these Terms from time to time. For changes that do not materially affect your rights or obligations, we will post the updated Terms with a revised "Last Updated" date. Your continued use of the Service after the updated Terms take effect constitutes acceptance.

Material Changes. For material changes - including any change to Section 10 (Limitation of Liability), Section 11 (Indemnification), or Section 15 (Dispute Resolution; Binding Arbitration) - we will provide at least thirty (30) days' advance notice in accordance with Section 18.3 and will require your affirmative acceptance of the updated Terms before you may continue to use the Service. Continued use alone does not constitute acceptance of a material change. If you do not accept, you may terminate your account and cancel your subscription as described in Section 9.

14. Governing Law & Venue

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

Subject to Section 15 (Dispute Resolution; Binding Arbitration), and for any dispute not subject to arbitration thereunder, the parties consent to exclusive jurisdiction and venue in the state and federal courts located in Colorado.

15. Dispute Resolution; Binding Arbitration; Class Action Waiver

15.1 Informal Resolution First. Before initiating arbitration, you agree to first contact us at support@edgebet.io with a written description of the dispute and the relief sought. The parties will attempt in good faith to resolve the dispute for sixty (60) days from receipt of that notice. This step is a condition precedent to commencing arbitration.

15.2 Agreement to Arbitrate. Except as provided in Section 15.5, any dispute, claim, or controversy arising out of or relating to these Terms or the Service - including their formation, interpretation, breach, termination, or validity - shall be resolved exclusively by final and binding individual arbitration, and not in a court of law. This agreement to arbitrate is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.

15.3 Arbitration Procedure. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration will be conducted by a single arbitrator. Unless the parties agree otherwise, any in-person hearing will take place in Colorado; you may alternatively elect a telephonic, video, or documents-only proceeding. The arbitrator has exclusive authority to resolve disputes over the scope, enforceability, or formation of this arbitration agreement, except that a court shall decide any challenge to Section 15.4. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.

15.4 Class Action and Jury Trial Waiver. YOU AND EDGEBET AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims or preside over any form of representative proceeding, and may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party's individual claim. YOU AND EDGEBET EACH WAIVE ANY RIGHT TO A JURY TRIAL. If this Section 15.4 is found unenforceable as to any claim or request for relief, that claim or request shall be severed and resolved in the courts identified in Section 14, and all remaining claims shall proceed in arbitration.

15.5 Exceptions. Either party may (a) bring an individual action in small claims court for any claim within that court's jurisdiction, and (b) seek injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement or misappropriation of intellectual property rights.

15.6 Your Right to Opt Out. You may opt out of Sections 15.2 through 15.4 by sending written notice to support@edgebet.io with the subject line "Arbitration Opt-Out," including your name and the email address associated with your account, within thirty (30) days of first accepting these Terms. Opting out will not affect any other provision of these Terms or your use of the Service.

15.7 Coordinated Filings. If twenty-five (25) or more similar demands for arbitration are asserted against EdgeBet by or with assistance from the same or coordinated counsel, the parties agree the demands shall be administered in sequential batches of no more than fifty (50), with a single arbitrator per batch, and that all applicable limitations periods shall be tolled for demands awaiting their batch.

15.8 Survival and Severability. This Section 15 survives termination of these Terms and of your account. If any portion other than Section 15.4 is found unenforceable, the remainder shall be given full effect.

15.9 Changes. If we materially amend this Section 15, the amendment will not apply to any dispute for which we had actual notice before the amendment's effective date.

16. Apple-Specific Terms

These Terms are between you and EdgeBet LLC only, and not with Apple Inc. ("Apple"). EdgeBet, not Apple, is solely responsible for the Service and its content.

License Scope. The license granted in Section 12, with respect to use on Apple devices, is a limited, non-transferable license to use the Service on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the Service may be accessed by other accounts associated with you via Family Sharing or volume purchasing. This Section does not limit the license granted in Section 12 with respect to the website or other non-Apple-device components of the Service.

Maintenance and Support. EdgeBet is solely responsible for providing any maintenance and support services for the Service. Apple has no obligation to furnish any maintenance or support services.

Warranty. EdgeBet is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in Section 17. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Service.

Product Claims. EdgeBet, not Apple, is responsible for addressing any claims by you or any third party relating to the Service or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights. In the event of any third-party claim that the Service or your possession and use of the Service infringes that third party's intellectual property rights, EdgeBet, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal Compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms. You must comply with applicable third-party terms of agreement when using the Service.

Third-Party Beneficiary. You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDGEBET LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND DATA SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE.

EDGEBET DOES NOT WARRANT THAT: THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; DEFECTS WILL BE CORRECTED; THE SERVICE OR ANY DATA, ODDS, LINES, CALCULATIONS, EXPECTED-VALUE ESTIMATES, ARBITRAGE INDICATORS, BONUS CONVERSION FIGURES, WAGER RECORDS, OR OPPORTUNITIES PRESENTED THROUGH IT WILL BE ACCURATE, COMPLETE, CURRENT, OR RELIABLE; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR PRODUCE ANY PARTICULAR RESULT, FINANCIAL OR OTHERWISE.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM EDGEBET OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain rights. To the extent such exclusions or limitations are not permitted, the provisions of this Section apply to the fullest extent permitted by applicable law.

18. General Provisions

18.1 Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to render it enforceable, or, if modification is not possible, severed from these Terms. All remaining provisions shall continue in full force and effect. This Section is subject to Section 15.4, which separately governs the consequences of a finding that the class action waiver is unenforceable.

18.2 Assignment. You may not assign or transfer these Terms, or any rights or obligations under them, by operation of law or otherwise, without EdgeBet's prior written consent. Any attempted assignment in violation of this Section is void. EdgeBet may assign these Terms in whole or in part, without restriction and without notice to you, including in connection with a merger, acquisition, corporate reorganization, financing, or sale of all or substantially all of its assets. These Terms bind and inure to the benefit of the parties and their permitted successors and assigns.

18.3 Notices. EdgeBet may provide notice to you by email to the address associated with your account, by posting a notice within the Service, or by any other reasonable means. Notice sent by email is deemed received twenty-four (24) hours after transmission, provided EdgeBet has not received a delivery-failure notification. You are responsible for keeping your account email address current, and EdgeBet is not responsible for your failure to receive notice due to an outdated or inaccessible email address. Notices to EdgeBet must be sent to support@edgebet.io and are deemed received upon EdgeBet's written acknowledgment or five (5) business days after transmission, whichever is earlier.

18.4 No Waiver. EdgeBet's failure to enforce any provision of these Terms is not a waiver of its right to do so later. Any waiver must be in writing and signed by an authorized representative of EdgeBet, and applies only to the specific instance identified.

18.5 Survival. Sections 4, 5, 6, 10, 11, 12, 14, 15, 16, 17, 18, and 20 survive any termination or expiration of these Terms or of your account.

18.6 Force Majeure. EdgeBet is not liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, natural disasters, labor disputes, internet or telecommunications failures, third-party data provider outages, governmental action, or changes in law.

18.7 No Third-Party Beneficiaries. Except as expressly provided in Section 16 with respect to Apple Inc. and its subsidiaries, these Terms confer no rights or remedies upon any person or entity other than you and EdgeBet.

18.8 Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.

20. Entire Agreement

These Terms, together with the Privacy Policy incorporated in Section 1, constitute the entire agreement between you and EdgeBet regarding the Service and supersede any prior agreements or understandings, whether written or oral. This Section is subject to Section 16, which governs the relationship between these Terms and Apple's applicable terms and conditions.
